The federal judge overseeing the Cook IVC filter multidistrict litigation (MDL) in the Southern District of Indiana has scheduled 3 bellwether trials to begin next year. The complaints allege that the devices contain design defects that make them likely to fracture, migrate and puncture internal organs after being implanted.

What’s the Problem?

August 11, 2016 – The bellwether trials will set the bar for more than 500 similar complaints alleging complications from Cook IVC filters. The 3 cases selected by Judge Richard L. Young allege a number of injuries caused by the Cook Celect and Günther Tulip filters.

The first bellwether trial (1:14-cv-6016) belongs to Elizabeth Jane Hill of Florida, who claims doctors were unable to remove her Cook Celect filter, which caused her “persistent severe gastrointestinal symptoms, fatigue, diarrhea, vomiting and abdominal pain.” It was later discovered that the device had punctured her inferior vena cava and become embedded in her intestine.

Hill went to several hospitals attempting to get the IVC filter removed. All attempts have been unsuccessful, and she now suffers from “narrowing at the explant site of the inferior vena cava and the bowel.”

The complaint alleges that Cook hid the “known risks and failed to warn of known or scientifically knowable dangers” associated with its IVC filters.

In addition to Hill’s suit, Judge Young has selected the following cases for the upcoming bellwether trials:

  • Brand v. Cook Medical, Inc. et al., Case No. 1:14-cv-6018 (Celect)
  • Gage v. Cook Medical, Inc. et al., 1:14-cv-1875 (Günther Tulip)

Last year, Young scheduled a series of settlement talks in hopes of resolving the cases before trial. If both parties fail to reach a settlement in the cases, the bellwether trials will proceed next year.
