A new lawsuit has been filed in Louisiana against DeRoyal Industries, Inc. on behalf of a woman who allegedly suffered permanent tissue damage after using one of the company’s cold therapy devices. The claim is just the latest in a growing number of lawsuits pending against manufacturers around the country involving cold therapy side effects.
Cold Therapy Lawsuit Update 8/7/12: A California woman was awarded more than $12 million in a landmark lawsuit filed over complications suffered after using a Polar Care 500 cold therapy device. What’s the problem?
May 31, 2011 – This month, a product liability lawsuit was filed against DeRoyal Industries in the U.S. District Court for the Eastern District of Louisiana on behalf of Toleda Rotolo, a woman who claims that the use of one of the company’s cold therapy devices caused her to suffer a permanent tissue damage injury.
According to the claim, Rotolo used a DeRoyal T505 cold therapy unit on her left knee for approximately three months before sustaining an injury that will reportedly require intensive long-term medical treatment. The lawsuit alleges that the device is fundamentally defective and dangerous, and that DeRoyal failed to provide adequate warnings about the risk of side effects.
Rotolo’s claim is just the latest in what appears to be an alarming trend in cold therapy injury lawsuits being investigated around the country. Last month, a Texas woman filed a nearly identical lawsuit claiming that a DeRoyal 600 cold therapy device caused permanent damage to her foot.
Cold Therapy Side Effects
Prolonged exposure to cold therapy ice machines may cause severe side effects in certain patients. In some cases, this severe damage may even be caused by as little as one hour of continuous contact with the unit. Cold therapy side effects may include one or more of the following:
- Skin damage
- Nerve damage
- Wrist, ankle, shoulder or back injury
- Hand amputation
- Foot amputation
- Loss of a limb
- Complex Regional Pain Syndrome (CRPS)
- Reflex Sympathetic Dystrophy (RSD)
Cold Therapy Device Manufacturers
Because cold therapy devices come with few instructions, patients may not know exactly how to use them. At Schmidt & Clark, LLP, we believe the manufacturers failed to provide proper instruction on correct use of the device and neglected to provide adequate safety warnings. If you have suffered from serious injuries as a result of a cold therapy machine, you may be eligible to recover compensation for pain, suffering, emotional distress, medical expenses, disfigurement and physical impairment.
