What’s the Problem?
The class action was filed against the Royal Caribbean-owned Celebrity Cruises by a Celebrity Apex crew member who allegedly fell ill aboard the ship, according to Business Insider.
Plaintiff Alexandra Nedeltcheva, a citizen of Bulgaria, claims he was working as a crew member aboard the Celebrity Apex on March 2, 2020, when approximately 1,400 other crew members and independent contractors boarded the ship at Chantiers de l’Atlantique in Saint-Nazaire, France. The Apex was set to embark on its maiden voyage.
Celebrity Cruises “acquired reason to suspect the presence of COVID-19 aboard the Celebrity Apex” on or about March 13, according to the lawsuit. The company reacted by failing to “flat-out restrict” non-essential crew member movements, both aboard the cruise ship and off the vessel. The next day, the U.S. Centers for Disease Control and Prevention (CDC) issued its first “no sail order” for the cruise industry.
From March 17 to March 21, Celebrity Cruises permitted independent contractors aboard the Apex “to freely travel on and off the vessel,” the complaint states. Plaintiff further alleges that the cruise line conducted “mandatory crew drills” with all crew members aboard the ship on March 21, and then threw a party for that featured “large buffet lines.”
Two days later, at least 7 crew members had been diagnosed with coronavirus; Nedeltcheva tested positive on March 30. By April 6, the number of ill grew to more than 350, with at least 8 serious cases of COVID-19 being transferred to a French hospital on shore.
“The exact number of members of the class is unknown at this time given that many members are currently in voluntary or forced isolation aboard Defendant’s vessels at this time; however, at this time it is estimated that there are in excess of 10,000 members,” the complaint states.
