The family of a woman who allegedly died after eating a caramel apple contaminated with listeria monocytogenes has filed a wrongful death lawsuit against the grocery store where the apple was purchased. As of Dec. 22, the Centers for Disease Control and Prevention (CDC) has linked 29 hospitalizations and 5 deaths to listeria-tainted caramel apples.

What’s the Problem?
81-year-old Shirlee Jean Frey bought a pre-packaged caramel apple at the Safeway grocery store in Felton, CA, shortly before Halloween, according to the wrongful death lawsuit. Frey ate it that week and began to feel sick shortly thereafter. Then on Nov. 6, Frey hit her head and was flown to Stanford Hospital, where she underwent surgery for what doctors suspected was a brain bleed. She was discharged Nov. 14 and her health appeared to be improving, according to the lawsuit.
Then on Thanksgiving, Frey did not wake up, and she was rushed back to Stanford Hospital. On Dec. 2, doctors told Frey’s family that she had listeriosis, and she died later that day, according to the lawsuit. It was later confirmed that Frey was the victim of a 10-state listeria outbreak linked to pre-packaged caramel apples.
“Since this is a pending lawsuit, we are not in a position to comment about the case,” said a Safeway spokesperson. “The product was supplied to us by a third party, and we are looking into this matter further. We were previously unaware of any issue as it relates to the specific sale of this product at our stores. We have removed the product from sale.”

Health officials from the FDA and California Department of Health investigated the facility and found evidence of listeria on surfaces likely to come into contact with apples.
