What’s the Problem?

In Oct. 2014, plaintiff Cathy James, who was pregnant at the time, ate a caramel apple that was purchased at Smith’s Pharmacy in Albuquerque, NM. According to the lawsuit, the apple was shipped from a Bidart Bros. packing plant in Shafter, CA, and contained Listeria monocytogenes, a bacterium that causes severe foodborne illness.

On Nov. 8, James sought medical attention for symptoms of food poisoning. Two days later, and months before her expected due date, she gave birth to a baby boy. Testing on the baby revealed he had contracted listeriosis from his mother. The baby was hospitalized for more than a month.

Health officials performed DNA tests on the sample of listeria taken from the baby, which was later determined to be associated with the multi-state outbreak linked to apples produced by Bidart Bros. The lawsuit was filed in the U.S. District Court of the District of New Mexico on Friday, Jan. 9, 2015, and names Bidart Bros. and Smith’s Food & Drug Centers, Inc. as defendants (case number 1:15-cv-00019).
