Cool Woman Files Lawsuit Over Listeria-Tainted Caramel Apple

What’s the Problem?

On Oct. 14, 2014, plaintiff Darlene Vouri reportedly bought a contaminated caramel apple at the Wal-Mart Supercenter on Crossings Drive in Rocklin, CA. She ate the apple and became sick 3 days later, according to court documents. Vouri was admitted to Sutter Auburn Faith Hospital, and subsequently diagnosed with spinal meningitis linked to listeria, the lawsuit alleges.

The complaint was filed on behalf of Vouri and her husband in Sacramento Superior Court, against Bidart Bros., Missouri-based caramel apple manufacturer Happy Apple Company, and Wal-Mart.

Leonard Bidart, president of Bidart Bros., said earlier this month that an FDA investigation which confirmed that listeria strains found at his Shafter processing plant were the same as those associated with the outbreak was “devastating.”

“As a family-owned grower operating in California since the 1930s, we place safety at the forefront of everything we do,” Bidart said. “Our hearts go out to all who have been impacted by the apple-related listeriosis outbreak.”
