What’s the Problem?
February 14, 2017 – The lawsuit was filed in the Southern District of California by 94-year-old Frances Escobedo, who alleges that J&J failed to warn about the risk of ovarian cancer with Johnson’s Baby Powder and Shower-to-Shower.
Plaintiff claims she was diagnosed with cancer in 2013 after using J&J’s talc products her whole life. As a result of her diagnosis, she was forced to undergo chemotherapy and radical life-saving surgeries.
Escobedo is hardly alone in her allegations against J&J. The 4th talcum powder ovarian cancer trial kicked off last week in St. Louis, in which more than 60 women and their families have filed complaints against the company.
Johnson & Johnson has recently suffered 3 costly defeats in St. Louis talcum powder lawsuits, amounting to approximately $195 million in compensation for ovarian cancer patients and their families. Hoping to reverse this trend, the company filed a request to have most of the other talc lawsuits pending in St. Louis to friendlier jurisdictions across the U.S. Judge Rex M. Burlison denied the request.
J&J says it plans to fight every lawsuit, rather than settle. The healthcare giant certainly has the financial muscle and legal resources at their disposal to keep fighting. However, they’ve got their work cut out for them. There are currently more than 2,000 talcum powder lawsuits pending against J&J in Missouri, California and New Jersey.
