What’s the Problem?
May 8, 2017 – The first Benicar lawsuits were filed in early 2014, and the federal cases were consolidated in April 2015 as part of a multidistrict litigation (MDL No. 2606) in New Jersey. A number of state court cases pending in New Jersey have been centralized as part of a multicounty litigation (MCL).
The suits were filed by plaintiffs who claim that side effects of Benicar caused them to develop sprue-like enteropathy, a severe gastrointestinal disorder associated with:
- Chronic Diarrhea
- Nausea and Vomiting
- Sudden Weight Loss
- Dehydration and Malnutrition
- Other Stomach Problems
As a result of drugmaker Daiichi Sankyo’s decision to withhold information regarding these problems, many former Benicar users have suffered extreme diarrhea for years, which often resulted in repeated hospitalization and medical treatment as doctors attempted to determine the cause of the problems.
As part of the coordinated pretrial multicounty and multidistrict litigations, it is likely that a small group of cases will be prepared for early trial dates, known as “bellwether” cases. While the outcome of these trials is not binding in other cases in the litigation, they are useful in helping gauge how juries may respond to evidence and testimony that is likely to be similar to what will be offered in a large number of cases.
