What’s the Problem?
Benicar (generic: olmesartan) is a hypertension medication prescribed to control high blood pressure, a condition that affects millions of Americans. Benicar was approved by the U.S. Food and Drug Administration (FDA) in April 2002.
On July 3 2013, FDA warned that Benicar warning labels would be updated with information about the risk of sprue-like enteropathy. According to the agency, this gastrointestinal problem can cause symptoms including chronic diarrhea with significant weight loss. Enteropathy may take months or even years to develop and may require hospitalization, FDA said.
Studies indicate that the chance for long-term gastrointestinal damage is increased the longer Benicar is used. It has also been suggested that sprue-like enteropathy is often misdiagnosed as “unclassified sprue” or celiac disease. This leaves patients continuing to take Benicar for high blood pressure, without realizing the medication may be causing their Illness and weight loss. Hypertension patients using Benicar to control their high blood pressure also face the risk of villous atrophy, a condition that occurs when the villi — the microscopic, finger-like tentacles that line the wall of the small intestine — erode away, leaving a virtually flat surface.
Plaintiffs in Benicar lawsuits allege that Daiichi Sankyo and Forest Laboratories knew about the link between Benicar and sprue-like enteropathy, and withheld information in order to maximize profits while putting the health of consumers at risk.
Given the ever-growing elderly population in the U.S., and the propensity for high blood pressure, the Benicar litigation is bound to grow in the coming weeks and months. The MDL is being overseen by U.S. District Judge Robert Kugler in the District of New Jersey. The case is In Re: Benicar (Olmesartan) Products Liability Litigation, Case No. 2606, in the US Judicial Panel on Multidistrict Litigation, District of New Jersey.
