Daiichi Sankyo Inc. has filed a request with the New Jersey Supreme Court to formally centralize dozens of lawsuits in the state alleging that Benicar and its other blood pressure medications caused users to develop a severe gastrointestinal side effect called sprue-like enteropathy.

What’s the Problem?
Daiichi said in a May 19 application to the Atlantic County, New Jersey court that consolidation of the lawsuits into a multicounty litigation (MCL) would conserve judicial resources while avoiding duplicate discovery and conflicting rulings by different judges, according to Law 360. The court posted a notice concerning the application and is accepting comments on the request until June 26.
To date, at least 58 cases over olmesartan-containing blood pressure medications have been centralized before Superior Court Judge Nelson C. Johnson. However, a similar lawsuit was filed last month in Hudson County, and counsel for the plaintiff in that case has refused to transfer it into the MCL.
“Judge Johnson is ably managing these cases as if they were centralized,” Daiichi said in the application. “However, given the volume of cases and the fact that plaintiffs’ counsel is now filing cases in other counties, the time has come for centralized case management to be formalized.”
Plaintiffs in the lawsuits allege that their use of blood pressure medications like Benicar, Benicar HCT, Azor and Tribenzor caused them to develop sprue-like enteropathy, a rare gastrointestinal side effect characterized by chronic diarrhea, weight loss and intestinal damage.
Allowing the lawsuits to proceed in different jurisdictions would make no sense, Daiichi argued.
“Centralized management in a multicounty litigation venue, with an experienced judge, will help ensure fairness to parties, provide a streamlined approach to case management and avoid the possibility of duplicative motion practice and inconsistent discovery rulings between multiple judges in Atlantic and Hudson counties,” the company said.
At the federal level, Benicar lawsuits have been formed into a multidistrict litigation (MDL) in the U.S. District Court for the District of New Jersey.
