What’s the Problem?
May 10, 2015 – The lawsuits allege that Daiichi Sankyo Inc. designed Benicar in a defective manner, and that the company failed to warn consumers that the drug could cause chronic diarrhea, nausea, malnutrition, dehydration, weight loss, and a rare gastrointestinal disorder called sprue-like enteropathy.
In July 2013, the FDA warned that Benicar had been linked to enteropathy and ordered that the drug’s warning label be updated to include information about this risk. At that time, the agency was aware of at least 23 cases of late-onset diarrhea among Benicar users. The connection between sprue-like enteropathy and Benicar was first reported in June 2012 by researchers at the Mayo Clinic who had identified 22 patients exhibiting symptoms similar to those produced by celiac disease, but whose blood tests did not support the diagnosis.
Benicar is classified as an angiotensin II receptor blocker (ARB), and is approved to treat high blood pressure (hypertension) in adults and children over the age of 6. The drug works by relaxing blood vessels so that blood can flow more easily and the heart can pump more efficiently. Lowering high blood pressure can help prevent strokes, heart attacks and kidney problems.
Benicar is widely-prescribed, as nearly 2 million patients filled a prescription for the drug in 2012 alone. This makes the potential for more individual lawsuits in different jurisdictions likely, prompting the creation of a multidistrict litigation in New Jersey, where both Daiichi and Forest Laboratories are headquartered.
