Update: Benicar Litigation Grows to 1800 Enteropathy Lawsuits
May 9, 2017 – The MDL regarding gastrointestinal problems and sprue-like enteropathy from Benicar continues to grow at a rapid pace, with more than 1,800 lawsuits centralized since mid-March. The complaints allege that Daiichi Sankyo withheld information regarding these Benicar side effects, which resulted in needless suffering for thousands of users, as doctors attempted to determine the cause of the problems.
Benicar Linked to Intestinal Problems (Sprue-Like Enteropathy): FDA Warning
In July 2013, the U.S. Food & Drug Administration (FDA) issued a warning which stated that Benicar and other olmesartan-containing blood pressure drugs may cause a rare intestinal complication known as sprue-like enteropathy. Symptoms of this condition may include severe, chronic diarrhea accompanied by significant weight loss. Enteropathy may develop months or even years after beginning treatment with Benicar, and may require emergency hospitalization.

Benicar Lawsuit Filed Over Chronic Diarrhea
In February 2014, a Benicar Lawsuit was filed on behalf of a Texas man who allegedly experienced severe intestinal complications after using the drug. Plaintiff George Edward Williams allegedly suffered chronic diarrhea, dehydration, weight loss, nausea, vomiting and malnutrition that required hospitalization for over 100 days. Williams’ back was also fractured, and he developed cataracts on his eyes from steroid drugs, and was left with permanent damage to his intestines.
Nearly 1,700 Lawsuits Consolidated in Benicar MDL
August 29, 2016 – At least 1,694 cases are currently pending in the Benicar multidistrict litigation (MDL 2606) in the U.S. District Court, District of New Jersey, and more could be added before the first bellwether trials make their way to court next year. And while their inclusion in the MDL is not a comment on the merit of the suits, it does speak to the fact that the complaints make similar allegations about Benicar side effects.
Judge Refuses Defendants’ Request to Dismiss 4 Benicar Lawsuits
April 25, 2016 – U.S. District Judge Robert B. Kugler has refused Daiichi Sankyo and Forest Laboratories’ attempt to dismiss 4 cases from the Benicar multidistrict MDL in Ohio. Defendants claimed that plaintiffs in 2 of the cases had injuries that occurred prior to their use of Benicar, and the other 2 cases involved injuries that were outside the scope of litigation. Kugler disagreed, finding that the MDL survives challenge to symptoms.
First Benicar Sprue-Like Enteropathy Lawsuits Will go to Trial Fall 2016
October 28, 2015 – Lawsuits filed over enteropathy side effects allegedly caused by Benicar will go to trial late next year in the U.S. District Court for the District of New Jersey in Camden, according to Judge Joel Schneider. The complaints allege that Benicar is dangerous and poorly-designed, and that the manufacturer failed issue adequate warnings about its potential risks. Click here to learn more.
