Update: New Jersey Woman Sues Bard Over Meridian IVC Filter Complications

June 20, 2016 – A woman from New Jersey who was allegedly injured after receiving a Bard Meridian IVC filter has filed a lawsuit against the manufacturer. The complaint (PDF) [1] was entered today in the MDL (IN RE: Bard IVC Filters Products Liability Litigation) on behalf of Plaintiff Renee Harris, who allegedly suffered unspecified injuries after being implanted with a Meridian vena cava filter in September 2013. Harris is seeking a jury trial as well as both compensatory and punitive damages.

Bard Meridian IVC Filter Lawsuit FAQ

The Bard Meridian IVC Filter is a tiny, umbrella-shaped device that prevents blood clots from traveling from the lower body to the lungs and/or heart. Patients are often implanted with blood clot filters if they are determined to be at risk of developing a pulmonary embolism, and are unable to use anticoagulant medications. Unfortunately, these devices have recently been found to have the tendency to fail after being implanted. When the arms or “struts” of Bard Meridian IVC filters rupture or break loose in the body, the following complications may result:

FDA Warning on Vena Cava Defects

In August 2010, the U.S. Food & Drug Administration (FDA) issued a warning [2] stating that IVC filter recipients faced a significant risk of developing adverse health complications (the longer the device remained implanted, the greater the risk). FDA implied that the devices should be removed as soon as the pulmonary embolism risk subsided. Since 2005, the agency has received at least 900 complaints about potentially defective vena cava filters.

Risks Posed by the Bard Meridian IVC Filter

  • The IVC filter can become stuck in the wrong area
  • The filter may change position after being implanted
  • The device may puncture nearby organs
  • IVC filter may break away from the implant site and migrate to the heart, lungs, or other organs
  • The filter may become so filled with clots that it can block all of the flow in the blood vessel
  • In some cases, “retrievable” filters are unable to be removed

Fracture / Embolization Warning Signs

Warning signs that an IVC filter has failed may include:

  • Severe pain in the heart or chest
  • Anxiety
  • Pulmonary embolus
  • Respiratory compromise
  • Hemorrhage
  • Perforation of organs, tissues, or blood vessels

Patients who believe their IVC filters may have fractured should contact their doctor immediately. A computerized tomography (CT) scan or other test will be used to determine whether the device has failed.
