A product liability lawsuit was recently filed against Eli Lilly & Co. on behalf of a man who allegedly had a pulmonary embolism after using Axiron, a popular testosterone supplement. As a result of his injuries, the plaintiff claims he will have to take prescription medication for the rest of his life to prevent additional vascular complications, and faces an increased risk of suffering a heart attack, stroke or sudden death.

Man Blames Axiron for Pulmonary Embolism
Plaintiff James A. Foley was 70 years old when he started using Axiron in April 2011, according to the lawsuit. Foley claims he took the supplement to treat symptoms he believed were caused by low testosterone levels. On October 11, 2012, he was hospitalized after suffering both a deep vein thrombosis (DVT) and pulmonary embolism (PE) – a blood clot in the lung.
Foley’s lawsuit, which was filed in the U.S. District Court for the District of Minnesota, accuses Eli Lilly & Co. of failing to adequately warn of the cardiovascular risks associated with using Axiron. Had Lilly more clearly identified the risks associated with the drug, the plaintiff claims he never would have taken it, or at least would have checked with his doctor more often to monitor his health. Foley is seeking damages in excess of $75,000.
Cardiovascular Risks of Testosterone Treatment
Axiron and other testosterone supplements have recently been criticized because of their potential to cause severe cardiovascular health complications. In July 2010, a study published in the New England Journal of Medicine (NEJM) found that older men with risk factors such as high blood pressure / cholesterol, diabetes and obesity were more likely to experience cardiovascular-related events if they used testosterone than if they didn’t. The injuries occurred so frequently that the researchers stopped the study early to protect the patients.
In November 2013, a study in the Journal of the American Medical Association (JAMA) found that testosterone users were at an increased risk of suffering a heart attack or stroke. Two months later, PLOS ONE published yet another study which determined that younger men with a pre-existing history of heart disease were twice as likely to have a heart attack in the first 90 days after starting treatment with testosterone supplements. All men over the age of 65, regardless of pre-existing cardiovascular disease, were twice as likely to suffer a heart attack if they were taking the drug.
