While still considered a significant victory for plaintiff Jesse Mitchell, the $3 million is a far cry from the $150 million he was awarded during the first trial in December, which was tossed after U.S. District Judge Matthew Kennelly determined the verdict was “logically incompatible.”

What’s the Problem?
March 27, 2018 – It is the 2nd verdict against AbbVie in the federal multidistrict litigation (mdl 2545) over the alleged side effects of AndroGel and other similar testosterone boosters. More than 6,000 complaints have been consolidated in the MDL, the vast majority of which have been filed against AbbVie, according to Reuters.
A federal jury in January found AbbVie not liable in another lawsuit filed by an Arizona man who allegedly developed a pulmonary embolism from AndroGel. The jury in the most recent trial concluded that AbbVie had not falsely marketed the drug and was not strictly liable, but that it had acted negligently. Mitchell was awarded $200,000 in compensatory damages and $3 million in punitive damages.
According to the lawsuit, Mitchell had a heart attack in 2012 after nearly 5 years of treatment with AndroGel. He recovered after several months, but was left with huge medical bills and an increased risk of suffering another heart attack, the complaint stated.
The lawsuit is: Mitchell et al. v. AbbVie Inc. et al. Case number 1:14-cv-09178.
