What’s the Problem?
May 6, 2016 – Many plaintiffs were told they had a million-dollar case against AMS, and one woman recently settled with the company for about $700,000, but it now appears that most victims will end up with a fraction of that amount.
This is why it is critical that you examine the fine print in the agreement before signing anything if you’ve been injured by a vaginal mesh device. The contract you sign with your law firm contains details that are easy to overlook, particularly if you are under pain or duress.
Some settlement firms require plaintiffs to sign special master agreements that include questions such as: Did you file for bankruptcy? Do you get disability? Did you take out a loan? Do you owe a doctor or hospital money?
Endo International purchased American Medical Systems for $2.9 billion in 2011. In October 2104, the company announced that it had set aside $1.4 billion in a mesh product liability fund. Endo reported in its 4th quarter of 2015 that it had paid out $150 million in AMS mesh settlements. As of April 2015, the company said it had “compromised and settled all claims” in about 360 cases in a dozen joint motions to dismiss. Endo said it will be settling over 100,000 more complaints through the end of next year for an average of $48,000 per claim.
