What’s the problem?
In June 2014, JAMA Internal Medicine published a study which found that men who took Viagra, whose active ingredient is in the same class as Adcirca, were 84% more likely to develop melanoma skin cancer compared to men who did not use the drug. The researchers theorized that sildenafil may cause melanoma because the drug affects the same genetic pathways that allow skin cancers to become more aggressive.
Has a Class Action Been Filed?
To date, no class action lawsuit has been filed over allegations of melanoma from Adcirca or other similar drugs. However, in April 2016, a multidistrict litigation (MDL No. 2691) was established for Viagra skin cancer lawsuits. The cases were consolidated before U.S. District Judge Richard Seeborg in the Northern District of California.
Factors in Adcirca Settlement Offers
In determining the amount of damages to award in Adcirca skin cancer lawsuits, a jury may consider these factors:
- The extent and duration of the injury, including hospitalization or other medical care;
- The effect that the injury had on the patient’s physical and/or mental health;
- Pain and mental anguish;
- Any long-term or lifelong disabilities which may affect the plaintiff’s health or quality of life;
- Losses related to wrongful death in the event that plaintiff died from his injuries;
- Past or future medical expenses, and
- Lost wages / loss of earning capacity.
