Actos Lawsuit Louisiana

An Ohio man has filed a lawsuit against Takeda Pharmaceuticals in Louisiana federal court alleging that his use of the type 2 diabetes medication Actos caused him to develop bladder cancer.

What’s the Problem?

According to the lawsuit, Plaintiff William Harstein of Orange, Ohio, began taking Actos to treat his type 2 diabetes in November 2006. On May 28, 2015, he was diagnosed with bladder cancer, which was subsequently confirmed by cystoscopy and pathology results, according to the complaint.

The lawsuit was filed on July 15, 2015, in U.S. District Court for the Western District of Louisiana. Mr. Harstein is seeking compensation for medical expenses, pain and suffering, mental anguish, and expenses related to the elevated cost of living incurred as a result of his cancer diagnosis. Additionally, Harstein’s wife Phyllis is suing for loss of consortium, consideration, compassion and care from her husband as he endures his illness.

Actos FDA Warning

In August 2011, the FDA issued a Drug Safety Communication which stated that it was requiring Takeda to update Actos warning labels with verbiage indicating that patients who use the medication for longer than 1 year may be at an increased risk of developing bladder cancer. FDA advised physicians to avoid prescribing Actos to patients with a history of bladder cancer, and to assess each patient’s risk for the disease prior to starting a regimen.

Bladder Cancer Symptoms

  • Blood or red color in urine
  • Urgent need to urinate
  • Pain while urinating (dysuria)
  • Urinating small amounts frequently
  • Frequent urinary tract infections

Symptoms that may indicate a more advanced bladder cancer include:

  • Lower back pain
  • Swelling in the lower legs
  • Growth in the pelvis near the bladder (pelvic mass)
  • Weight loss
  • Bone pain or pain in the rectal, anal or pelvic area
