Abilify Lawsuit Filed in California

What’s the Problem?

June 9, 2016 – According to the lawsuit (PDF), which was filed in the U.S. District Court for the Eastern District of California in January, plaintiff Brenda Sears suffered injuries and developed compulsive behaviors as a direct result of her use of Abilify.

Brenda and her husband Robert are suing Bristol-Myers Squibb Co., Otsuka Pharmaceutical Co. LTD and Otsuka America Pharmaceutical Inc. because the companies allegedly manufactured and distributed Abilify despite having knowledge of the drug’s potential to cause serious side effects, and for failing to adequately warn of these potential problems in the product’s labeling or advertisements.

Plaintiffs request a trial by jury and seek actual damages, injunctive relief and injunction against the defendants, disgorgement of all profits made from Abilify, punitive damages, interest, all legal fees and any other relief as the court deems just. Alleged damages include breach of implied warranty, breach of warranty, negligent misrepresentation and other counts. The case is: U.S. District Court for the Eastern District of California Case number 1:16-cv-00065-LJO-BAM.
