Over the last three decades we have seen an explosion of injury lawsuits regarding toxic tort litigation. This is in part due to long latency periods associated with exposure to these substances and the subsequent development of the disease or illness the person is suffering from.

Due to these long latency periods, it is often very difficult to pinpoint the exact cause of a person's illness or disease. It is equally difficult in some cases to determine when and how they were exposed to a toxic chemical or pollutant until creating an extensive history profile including where they have lived and worked over their lifetime for each plaintiff in these types of lawsuits.

Generally, toxic tort lawsuits will be filed when an individual or entity has exposed someone to toxic chemicals or pollutants and displayed gross negligence. Negligence can include pollution of the environment such as groundwater contamination, soil contamination and air contamination or the failure to warn workers and consumers of potential health dangers with their products and not providing protective safety equipment.
