Simplicity & Graco Crib Recall Lawsuit

Crib Recall In two of the largest crib recalls in history, the U.S. Consumer Products & Safety Commission (CPSC) recalled almost 2 million cribs made by Simplicity Inc. and Graco Children’s Products, Inc. because of a product design defect that has led to the deaths of at least three children, seven infant entrapments and 55 “incidents” in the Simplicity & Graco baby/infant cribs.

UPDATE: As of April 14, 2009, Simplicity, Inc. appears to no longer be in business.  The CPSC is advising consumers to dispose of these cribs, even if it is believed that the hardware and drop side have been installed correctly. All of the recalled cribs have the potential to pose a danger to young children.

What’s the problem?

The recall of at least 1 million Simplicity & Graco cribs was initiated by the CPSC because on certain crib models, the drop-side can detach from the crib, which can create a dangerous gap and lead to the entrapment and suffocation of infants.

Missteps delayed recall of deadly cribs

Despite 55 complaints, seven infants left trapped and three deaths, it took years for the Consumer Product Safety Commission to warn parents about 1 million flawed cribs.

Our California colleagues have recently settled a wrongful death lawsuit against Simplicity, Inc., Graco Children Products Inc. and Wal-Mart for the wrongful death of a nine month old infant who suffocated to death after becoming trapped between the side rail and the mattress of a crib manufactured by Simplicity Inc. In addition, they have filed a class action lawsuit in Federal court on behalf of parents who purchased defective Simplicity and Graco cribs.

2008 Simplicity Crib Recall List

The cribs manufactured by Simplicity, made in China and sold at a variety of department stores, children’s stores and mass merchandisers nationwide from January 2005 through August 2008 for between $150 and $300. The recalled model numbers include: 8620, 8745, 8748, 8755, 8756, 8778, 8810, and 8994. The recalled drop side cribs have a date code, which can be found on a label on the headboard under the mattress support, which ends in 05DH, 05GB, 06DH, 06GB, 07DH or 07GB (examples: 1806 DH or 0507 GB).

2007 Simplicity & Graco Crib Recall List

The cribs manufactured by Simplicity & Graco were made in China and were sold in department stores, children’s stores and mass merchandisers nationwide from January 1998 through May 2007 for between $100 and $300.

The recalled cribs have one of the following model numbers, which can be found on the envelope attached to the mattress support and on the label attached to the headboard: 4600, 4605, 4705, 5000, 8000, 8324, 8800, 8740, 8910, 8994, 8050, 8750, 8760, and 8996.
