DePuy Pinnacle Hip Replacement Litigation Moving Forward
April 24, 2012 – Legal teams involved in the federal DePuy Pinnacle hip litigation are scheduled to meet with the MDL Court tomorrow, where they are expected to outline a schedule for proceeding with the cases. The conference will be overseen by U.S. District Judge Ed Kinkeade, who is presiding over the litigation. To date, more than 1,000 DePuy Pinnacle hip replacement injury cases have been transferred into the MDL.

What’s the problem?
All of the DePuy Pinnacle hip replacement lawsuits in the MDL involve similar claims that design defects with the device caused plaintiffs to experience problems with the implant within just a few years, often resulting in the need to undergo painful revision surgery.
In anticipation of tomorrow’s meeting, Judge Kinkeade requested that all parties meet with a Special Master to discuss their various opinions on the litigation, whether separate tracks should be created for different versions of the Pinnacle, and how to coordinate the cases with claims pending on the state level. The legal teams were also asked to come up with a comprehensive long-form and short-form complaint procedure, a document that will be completed by each plaintiff to provide specific information on the background of their claim.
In addition to troubles with the Pinnacle hip, DePuy and Johnson & Johnson also face thousands of lawsuits over their failed ASR hip replacement, which was recalled nationwide in August 2010 after it was found to break down at a much higher-than-expected rate. The ASR litigation has been consolidated into its own MDL, which is currently pending in the U.S. District Court for the Northern District of Ohio.
The ASR device was approved under the FDA’s controversial 510(K) program, which is designed to fast-track medical devices and drugs that are ‘substantially equivalent’ to products already on the market. According to allegations raised in several complaints, a DePuy Pinnacle hip recall should be conducted due to the device’s similarity to the recalled ASR.
