Nationwide Frozen Pot Pie Salmonella Recall Lawsuit

ConAgra Foods Inc. has issued a nationwide "Class I" recall of its popular Banquet brand Chicken and Turkey Pot Pies, as well as other generic brands due to a massive, multi-state outbreak that has sickened at least 238 people in 35 states with Salmonella food poisoning.

What’s the problem?

The U.S. Centers for Disease Control & Prevention (CDC) is working in conjunction with public health officials in multiple states across the country and with the U.S. Department of Agriculture Food Safety Inspection Service (FSIS) to investigate an ongoing multi-state outbreak of Salmonella infections.

The CDC stated that the likely source of the Salmonella outbreak is any pot pies manufactured by ConAgra Foods, Inc. and classified the recall as Class I. This type of recall means that this is a health hazard situation where there is a reasonable probability that the use of the product will cause serious, adverse health consequences or death.

Frozen Pot Pie Recall List

The frozen pot pies include all varieties in 7 oz. single serving packages bearing an establishment number "P-9" or "Est. 1059" printed on the side of the package for the following brands:

• Banquet
• Albertson's
• Food Lion
• Great Value (sold at Wal-Mart)
• Hill Country Fare (sold at HEB)
• Kirkwood (sold at Aldi)
• Kroger
• Meijer
• Western Family

Salmonella Outbreak Demographics

Between January 1, 2007 and October 29, 2007 the CDC identified at least 238 isolates of Salmonella I 4,[5],12:i:- (pronounced “four five twelve eye minus”) between January 1, 2007 and October 29, 2007 in the following 35 states:

Arizona (1 person), Arkansas (4), California (16), Colorado (7), Connecticut (6), Delaware (5), Florida (2), Georgia (2), Idaho (8), Illinois (6), Indiana (3), Kansas (3), Kentucky (8), Massachusetts (6), Maryland (7), Maine (1), Michigan (3), Minnesota (7), Missouri (16), Montana (4), Nevada (6), New York (10), Ohio (10), Oklahoma (1), Oregon (3), Pennsylvania (17), Tennessee (6), Texas (4), Utah (12), Virginia (9), Vermont (2), Washington (17), Wisconsin (23), Wyoming (3).

People affected by the pot pie salmonella outbreak range from <1 to 87 years of age with a median age of 20 years; 51% of ill persons are female. At least 50 people have been hospitalized.

Symptoms of Salmonella Food Poisoning

Most people infected with Salmonella develop diarrhea, fever, and abdominal cramps 12–72 hours after infection. Infection is usually diagnosed by culture of a stool sample. The illness usually lasts 4 – 7 days. Although most people recover without treatment, severe infections may occur. Infants, elderly persons, and people with impaired immune systems are more likely than others to develop severe illness. In severe infection, Salmonella spreads from the intestines to the bloodstream and then to other body sites, and death can occur if the person is not treated promptly with antibiotics.
